Cloud Telephony & VoIP Solutions

1. Introduction

 

This Fair Usage Policy (“FUP”) governs the acceptable use of VoIP, Cloud Telephony and AI-enabled Services provided by technologE Ltd (“technologE”).

This FUP forms part of the Agreement and is incorporated as a “Fair Usage Document” for the purposes of Schedule 3 – Cloud Telephony & VoIP Solutions .

This FUP applies in addition to:

  • The Master Terms & Conditions

  • Master Terms & Conditions v3(17…

  • The applicable Schedule

  • The Order Form

  • The relevant Price List / Rate Card

  • Any third-party platform terms (including Cisco Webex and 3CX)

 

Where Services are delivered via Cisco Webex or 3CX platforms, the applicable platform licence terms and usage policies apply in addition to this FUP. In the event of conflict, the stricter provision shall prevail.

This FUP ensures fair access for all Customers, protects service integrity, prevents abuse and mitigates financial, regulatory and security risks.

The Services (including AI functionality) are not intended for life-critical, emergency, medical, aviation, defence or other high-risk environments unless expressly agreed in writing.

2. Definitions

 

For the purposes of this FUP:

User means any individual or entity accessing the Services.

Account means a registered Customer account tied to billing and usage tracking.

Inclusive Minutes means bundled call minutes included within a purchased package.

Tariff means the per-minute/per-call pricing specified in the Order Form or, where not specified, the applicable Rate Card (as defined in Schedule 3)

AI Service means transcription, summarisation, sentiment analysis, meeting insights, automated call summaries, messaging rewrite, translation or other AI-driven processing provided via Cisco Webex, 3CX or other supported platforms.

AI Output means any machine-generated transcript, summary, analysis, recommendation or other output. AI Output may contain inaccuracies, omissions or hallucinations. technologE makes no warranty as to its accuracy or fitness for purpose.

Service Abuse means any activity that impairs system integrity, degrades performance, causes excessive load, circumvents usage controls or exposes technologE to financial or legal risk.

3. Prohibited Uses

 

The following are strictly prohibited:

3.1 Telephony Misuse

  • Operating call centres, predictive diallers or bulk outbound campaigns using inclusive bundles.

  • Reselling call traffic or exploiting bundled allowances commercially.

  • Artificial traffic generation, call pumping, SIM boxing or arbitrage.

  • Routing traffic through VoIP gateways or forwarding loops to exploit international inclusion.

  • Presenting invalid or misleading CLI.

  • Any use materially inconsistent with normal UK-based business communications.

3.2 Legal & Regulatory Breaches

  • Processing content obtained without required consent.

  • Breaching GDPR, PECR, Ofcom regulations or telecommunications law.

  • Uploading unlawful or exploitative content.

  • Processing special category personal data via AI Services unless explicitly agreed and configured.

3.3 AI Service Misuse (Cisco Webex & 3CX)

  • Excessive transcription or analysis beyond reasonable business usage.

  • Automated scraping, dataset extraction, benchmarking or model comparison.

  • Reverse engineering or attempting to extract proprietary model details.

  • Circumventing rate limits or concurrency limits.

  • Using AI Output to mislead, impersonate, defraud or create deepfake-style content.

  • Introducing malware, corrupted files or adversarial inputs.

  • technologE reserves discretion to determine whether use constitutes abuse.

4. Usage Limits

4.1 Inclusive UK Call Allowances

Unless otherwise stated in the Order Form:

  • Cisco Webex Voice, Calling, Suite and Customer Experience packages include up to 2,000 UK minutes per licensed User per calendar month.

  • Common Area licences include no inclusive minutes.

Inclusive minutes apply only to:

  • UK geographic numbers (01, 02, 03); and

  • UK mobile numbers (071–075, 077–079), excluding premium or special ranges.

Inclusive allowances:

  • Apply only within the relevant billing period;

  • Do not roll over;

  • Exclude international, premium, directory, satellite and special-service numbers unless expressly included.

4.2 International Inclusion (Cisco Webex)

Where included in the purchased package, inclusive international minutes apply only to standard geographic and mobile numbers within:

  • European Union member states

  • United States

  • Canada

  • Australia

  • New Zealand

Exclusions include premium, satellite, revenue-share and non-geographic ranges.

“Inclusive” or “Unlimited” calling remains subject to reasonable business use.

4.3 Tariffs and Chargeable Calls

Chargeable calls are billed at the Tariff specified in the Order Form or, where not specified, the applicable Rate Card

Tariff details (including per-minute rates, call set-up fees, minimum call charges and billing increments) are available on request or via the relevant Price List.

Usage is billed in arrears. Inclusive allowances do not roll over.

4.4 AI and Platform Limits

technologE reserves the right to impose and enforce limits including:

  • Daily or monthly transcription duration

  • Number of analysis requests

  • File size limits

  • Concurrency limits

  • Storage and retention caps

  • Meeting capacity limits

  • API rate limits

Platform-imposed limits by Cisco Webex, 3CX or underlying carriers apply automatically.

Exceeding limits may result in throttling, additional charges, suspension or feature disabling.

5. Monitoring and Enforcement

 

technologE may monitor usage patterns to detect fraud, abuse or excessive load, including:

  • Call volumes and destination patterns

  • International usage

  • AI request rates

  • Metadata (IP addresses, request frequency, file size)

Fraud monitoring is provided on a best-efforts basis and does not guarantee prevention.

Underlying carriers and platform providers may apply barring, rate limits or destination blocking. technologE is not liable where such controls are lawfully applied.

6. Consequences of Violation

 

Where this FUP is breached, technologE may:

  • Apply excess Charges

  • Remove inclusive allowances

  • Throttle or restrict usage

  • Suspend or terminate Services

  • Report unlawful activity to authorities

Liability arising under this FUP is subject to clause 13 of the Master Terms

Charges continue to accrue during suspension.

7. Changes to This Policy

 

technologE may update this FUP from time to time.

The latest version will be published and forms part of the Agreement upon publication.
